The company TALENTSOFT, a public limited company registered on the NANTERRE trade and companies register, under number 497 941 377, with its head office located at 8 Rue Heyrault, CS 10157, 92643 Boulogne-Billancourt, France (hereinafter referred to as “TALENTSOFT” or “We”), is the organiser of the “Club Talentsoft 2021” event, held online on the CLUBTS Website, accessible via: www.club-talentsoft.com (hereinafter, the “Website”), on 8 June 2021.
Access to the “Club Talentsoft 2021” event is reserved for people who have registered on the Website (hereinafter “You”, the “User” or the “Participant”). 

By visiting our Website You agree to comply with the following Terms and Conditions (hereinafter referred to as “T&C”).

Article 1- Definitions: 

T&C: means the following General Conditions of Use. 

 Live chat: means the Website feature that allows You to directly interact and ask your questions during the Live event. 

Private chat: means the Website feature that allows you to liaise with other Participants or directly with TALENTSOFT.

 Data: means all Data related to or referring to the use of the Website and/or all Data collected during the Event, including personal data as defined by the EU Regulation 2016/679 on personal data protection. 

Event: means the “Club Talentsoft 2021” event, organised by TALENTSOFT, accessible online via the Website on 8 June 2021. 

Live: means the conference that We will broadcast in real time on the Website during the Event. 

Partners: means the TALENTSOFT partners attending the Event. The list of TALENTSOFT partners can be found here 

Participants: means persons registered on the Website and who have created an account to attend the Event. 

 Host: means the company INFINITE SQUARE who hosts the Website. 

Website or CLUBTS Website: means the www.club-talentsoft.com website. 

Article 2 – Website obligations: 

2.1 The Website and its linguistic variations constitute the whole and exclusive property of TALENTSOFT.    

TALENTSOFT, as publisher of the Website, grants any person who visits the Website a private, personal, non-transferable, non-assignable, and non-exclusive viewing rights.

2.2 All data of any nature, including text, graphics, logos, icons, images, audio and video clips, trademarks, software, and features of the TALENTSOFT website, appearing on the Website and on its various versions, are protected by copyright, trademark, and all other intellectual property law, and belong to TALENTSOFT as a company, or to authorised third parties. 

 2.3 When browsing the Website, You agree not to reproduce, summarise, edit, alter or redistribute, without our prior authorisation, any text, title, application, software, logo, image, video, branding, trademark, information or illustration, for any purpose other than for strictly personal use. Any other form of representation (e.g. for professional, commercial or redistribution purposes) without prior express and written authorisation is strictly prohibited. 

 2.4 Users are strictly prohibited from extracting all or part of the Website for content import and storage purposes.  

2.5 Any creation of hypertext links from a website to our Website shall be subject to prior express authorisation by TALENTSOFT. This authorisation may be withdrawn at any time by TALENTSOFT without lawful justification required.

 2.6 Third-party websites are not under the responsibility of TALENTSOFT. TALENTSOFT is in no way responsible for the content of these websites, the links they may contain, or the changes or updates made to their content. Where required, TALENTSOFT provides these links for convenience or information purposes, and the inclusion of any link does not imply prior approval of the corresponding website by TALENTSOFT. The risks related to the use of these websites are the full responsibility of the User, who shall comply with the general conditions of use of the websites in question.  

Article 3- Access and availability: 

3.1 Access to the Website is determined by the User’s registration and is provided on a continuous and permanent basis, except in the event of a force majeure or events beyond the control of TALENTSOFT, and subject to possible technical failures and interventions, maintenance or necessary updates required to ensure the proper functioning of the Website. 

 3.2 THE WEBSITE IS ACCESSIBLE “AS IS”. TALENTSOFT CANNOT BE HELD RESPONSIBLE FOR INDIRECT DAMAGES THAT MAY OCCUR FROM USING THE WEBSITE, INCLUDING LOSS OF BENEFITS, PROFIT, IMAGE, CLIENTELE, BUSINESS, REPUTATION OR EXPECTED GAIN, TIME SPENT BY EMPLOYEES OR SERVICE PROVIDERS OR LOSS OF OPPORTUNITY.  

TALENTSOFT CANNOT BE HELDLIABLE FOR ANY LOSS OR DAMAGE RESULTING FROM THE NON-COMPLIANT OR ILLEGAL USE OF THE WEBSITE. 

 3.3 The User is solely responsible for both the IT equipment and internet connection used for accessing the Website. The User is responsible for taking all necessary measures to protect the equipment and network, notably from any form of infection by viruses, malware, worms, logic bombs, Trojan horses, or any other element of code, files, programs, scripts and/or malicious or harmful agents. 

Article 4 – Website content: 
 Access to the Website is subject to User registration. The information contained on the Website or provided during the Event is of a general and descriptive nature. It cannot be considered as binding nor does it constitute a firm obligation from TALENTSOFT. 

 Article 5 - Club TALENTSOFT 2021: 

5.1 GENERAL INFORMATION  

TALENTSOFT is the Event organiser. The Event organisation procedures, notably the date, duration, opening and closing times and programme are determined by TALENTSOFT and can be changed at any time by TALENTSOFT. Registered persons will not be able to claim compensation in this case. 

5.2 REGISTRATION 

 To access the Event, the User must register by completing the registration form, available on the Website. The User will not be able to access the Website or the Event without prior registration. 

 Registration for the Event is free. We will send You confirmation of your registration as well as any information relating to the Event to the email address You provided via the registration form. We will not be held responsible if the email address provided is invalid or incorrect.

5.3 CREATING AND MANAGING YOUR ACCOUNT 

 Once your registration is taken into account, You must create an account in order to participate in the Event by providing an email address and creating a password. Your password will be stored by TALENTSOFT for the sole purpose of creating your account. Your password is confidential and cannot be accessed by TALENTSOFT, its Partners, other Participants, or any other third party. 

You are responsible for the security of your login details. If you share your login details and password with a third party, you are liable for how the account is used and any information disclosed, added, deleted and edited by this third party. 

 Your account includes the Data You provided during your registration by default. You can however change and update your account information at any time.  

This information constitutes personal data and is processed in compliance with our privacy policy. Please see our Privacy policy for further information.  

Creating an account is mandatory in order to attend the Event, liaise with other registered participants and TALENTSOFT, and schedule meetings with Partners. 

 You can request to delete your account at any time. In any case, your account will be deleted six months after the Event, allowing you to access the Event replay. 

 ARTICLE 6 – MESSAGES  

During the Event, You can: 
- Use the Private Chat to liaise with other Participants and/or directly with TALENTSOFT; 
 - Use the Live chat. When using one of these communication methods, your representatives will have access to your Data. For more information on how TALENTSOFT processes your personal data, please read our Privacy policy.   

You are responsible for the content of messages you publish during the Event using these communication methods. As such, you agree not to send:
 - Third-party messages or links that are of an offensive, defamatory, racist, xenophobic, pornographic, or child pornographic nature, inciting either explicitly or implicitly illicit language, and more generally any content that is against applicable law, public order and correct behaviour; 
 - Personal data or data which would fail to respect privacy, or contravene the image rights or intellectual property rights of third parties, individuals or legal entities. TALENTSOFT shall not be held accountable for any violation of image or intellectual property rights of such third parties. As such, you agree to compensate TALENTSOFT for all costs, fees, and expenses that TALENTSOFT would incur as a result of this violation. 

 You are encouraged to inform TALENTSOFT immediately of any message of seemingly illegal nature, or that contravenes these GCU. TALENTSOFT cannot be presumed to have knowledge of the illegal nature or non-compliance of the content of messages published on the Website. 

In accordance with French Act No. 2004-575 of 21 June 2004 regarding Confidence in the Digital Economy (hereinafter referred to as "LCEN"), TALENTSOFT does not perform any prior verification of messages published on the Website. TALENTSOFT reserves the right, at its sole discretion and without notice, to delete all the messages that violate the current legislation or these GCU. Users of the Website are encouraged to notify TALENTSOFT of any content that is unlawful or contrary to the GCU. TALENTSOFT agrees and undertakes, promptly upon receipt of such notification, to verify said content and to withdraw it, where applicable. TALENTSOFT cannot be presumed to have had knowledge of the unlawfulness of the content or of the failure of said content to comply with these GCU. 

Article 7- Personal Data:

 In general, You can access the Website without providing your Personal Data. However, some services offered by the Website (such as registration and participation in the Event, marketing communications) require that You provide TALENTSOFT with your personal data. 

 The conditions under which TALENTSOFT processes users’ personal data, in accordance with the provisions set out in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, and the French Data Protection Act no. 78-17 of 6 January 1978, as amended, relating to information technology, computer files and liberties, are defined in our Privacy policy. 

Article 8- Cookies: 

 Cookies are used on the Website. A description of cookies and similar technology used on the Website can be found in the Website’s Cookies policy.

9.2 The Website, linguistic variations, and structure, may be subject to modifications and developments without any form of notification. TALENTSOFT reserves the right to unilaterally modify these GCU, without prejudice to user rights. We recommend You refer to our T&C, Privacy policy, and Cookies policy on a regular basis. 

 9.3 In the event where one of the provisions contained in the GCU is deemed to be void as a result of a current or future legal or regulatory provision, or as a result of a legal decision that has the force of res judicata and is issued by a competent jurisdiction or body, this provision shall be considered void but all other provisions of these GCU remain enforceable between TALENTSOFT and the Website users. 

 9.4 The Website, including these GCU, the Privacy policy, and the Cookies policy, are subject to French law, both in terms of basic rules and rules governing their form. 

 9.5 These GCU were drawn up in English and in French. In case of differences or contradictions between linguistic versions, only the French version of the GCU shall apply.
