The company TALENTSOFT and its subsidiaries pay very close attention to guaranteeing respect for the rights and freedoms of Users.
TALENTSOFT undertakes to ensure all legal and regulatory provisions applicable to the protection of personal data are respected, and particularly EU Regulation 2016/679, of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as “GDPR”) as well as the French Data Protection Act 6 January 1978, as amended (hereinafter referred to as the “Act”).
This Privacy Policy describes the categories of data that TALENTSOFT collects from you, the reasons for collecting them, the way in which TALENTSOFT uses these data, as well as the rights you are entitled to. 


Article 1 – Definition:

Data: means your personal data as defined by the European Regulation 2016/679, of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
Event: means the event “Club Talentsoft 2019”, hold by TALENTSOFT at Barcelona, Spain, on 4th and 5th June 2019.
Exhibitor: means company with which TALENTSOFT entered into a partnership agreement and which is authorised to held workshops, scan your badge and access to your Data.
Website: means the website www.club-talentsoft.com.


Article 2 - What is personal data?

As defined by the French National Data Protection Authority (CNIL), the Act, and the GDPR, personal data means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.


Article 3 - Data Controller

TALENTSOFT is the controller with regard to your personal data. TALENTSOFT may be contacted through the following means:

Article 4 - Categories of Data you share with TALENTSOFT

On a general basis, you can access the Website without having to provide any personal data. TALENTSOFT does not process data that allows it to identify you as a person, directly or indirectly, unless you have willingly provided this information by filling in the various forms that are provided to you or made available on the Website.
In the context of Website access and use, personal Data that may be requested by TALENTSOFT are effectively your name, surname, job title, phone number, email, country, and if you take part in a delegation and if TALENTSOFT support your travel and accommodation, you date of birth, number and expiration date of your identity card or of your passport. This information is considered as personal data in the sense of the general data protection reglementation (GDPR).
On the Website, an asterisk indicates Data required in order to access the service.
TALENTSOFT shall process your Data for the purposes and duration described in this document.
When you communicate your Data, you provide us with a guarantee that you have received the authorizations and consent required from the individuals concerned by these Data if the Data concerns people other than yourself and, where applicable, for the purposes described in this document.
Data shall be processed using computer technology and stored in databases located exclusively within the European Union.
When you provide us with your Data, you warrant that you have received any relevant authorization and consent from the relevant data subject, if they concern other persons than you, for the purposes described hereafter.

Article 5 - Recipient of your Data

TALENTSOFT may share your Data with other entities within the TALENTSOFT group, for the sole purposes provided in Article 6 of this Privacy Policy and under the strict conditions set out in this Privacy Policy.
TALENTSOFT share your Data with the Partner to host and Website’s performance purposes.
TALENTSOFT may share your Data with the travel agency that TALENTSOFT shall contact in order to organize your travel and accommodation.
TALENTSOFT may share your Data to:
- the Exhibitor which is holding the workshop in which you are taking part in;
- the Exhibitor which obtained your express consent to scan your badge by using the phone interface “Club TS”. TALENTSOFT may share your Data with people registered to the same workshops than you.
Besides the recipient listed in this article, your Data are not communicated nor transferred to any other third party.
All the recipients of your Data are required to respect data confidentiality and to process your data for the purposes listed in the article 6.
However, TALENTSOFT may be obliged, under the Act and/or the GDPR, or under any other applicable legal provision, to communicate your Data following a court ruling, order, decree, or any other applicable legal provision and/or regulation.


Article 6 - Purpose for processing your Data

When you give us your Data, TALENTSOFT shall process your Data for one or more of the following purposes:

6.1 Hosting your Data
When you communicate us your Data, we share it with our Partner in order to host and store it.
For this purpose, we shall process your Data:
- During the contractual relations between TALENTSOFT and the company which you are from; or
- For the duration of the Event, until June 6th, 2019.
After the relevant date, depending on your situation, your Data shall be erased unless you ask us to keep it.
For this purpose, we process your data, and in accordance with article 6, paragraph 1, point (b) of the GDPR, we process your Data in order to take steps at your request to attend to the Event.

6.2 Registering to the Event
Your registration to the Event is taken into account only if you submit us the relevant form, completed with your Data. The communication of your data is mandatory in order to confirm your registration and allow you to attend to the Event while providing you with any useful information regarding your attendance. We shall also use your Data in order to provide us with any relevant information regarding the Event.
Once your Data have been communicated and your registration is confirmed, you shall receive a confirmation of your registration and any relevant information in order to attend to the Event. We will not be liable if the communicated email address is incorrect or invalid.
For this purpose, we shall process your Data:
- During the contractual relations between TALENTSOFT and the company which you are from; or
- For the duration of the Event, until June 6th, 2019.
After the relevant date, depending on your situation, your Data shall be erased unless you ask us to keep it.
For this purpose, and in accordance with article 6, paragraph 1, point (b) of the GDPR, we process your Data in order to take steps at your request to attend to the Event.

6.3 Creation of an account
You can create an account in order to participate to the workshop hold by the Partners. The communication of your data is mandatory in order to confirm your registration and allow you to attend to the workshops while providing you with any useful information regarding your login.
For this purpose, we:
• shall process your Data for the duration of the Event, until June 6th, 2019. After that date, your Data shall be erased unless you ask us to keep it.
• Process your Data in order to take steps at your request to attend to the workshops of the Exhibitors, in accordance with article 6, paragraph 1, point (b) of the GDPR.

6.4 Organization of your travel and accommodation to attend to the Event
Subject to having communicated to us your data for the purposes provided for in article 6.2 and if TALENTSOFT supports and organizes your travel and accommodation to attend to the Event according to the General Conditions of Use, your Data shall be used in order to proceed with the booking of your travel, of your accommodation, and to send you an email with any relevant information. We will not be liable if the communicated email address is incorrect or invalid.
For this purpose, we:
• shall process your Data for the duration of the Event, until June 6th, 2019. After that date, your Data shall be erased unless you ask us to keep it.
• Process your Data in order to take steps at your request to attend to the Event, in accordance with article 6, paragraph 1, point (b) of the GDPR.

6.5 Access to the Event
A control shall be conducted in order to access to the premises of the Event, and TALENTSOFT shall scan your badge.
For this purpose, we:
• Shall process your Data for the duration of the Event, until June 6th, 2019. After that date, your Data shall be erased unless you ask us to keep it.
• Possesses has a legitimate interest in controlling the accesses in accordance with article 6, paragraph 1, point (f) of the GDPR, to control the identity of participants, and to ensure the security of the Event.

6.6 Registering to the workshops
Subject to having communicated to us your data for the purposes provided for in articles 6.2 and 6.3, you will have the possibility to register to the workshops organized by the Exhibitors, partners of TALENTSOFT during the Event.
If you choose to register for one of these workshops, we will send your Data to this exhibitor to get a list of people who want to attend the workshop and we will make your Data available to the users that will participate to the same workshop than you.
For this purpose, we:
• shall process your Data for the duration of the Event, until June 6th, 2019. After that date, your Data shall be erased unless you ask us to keep it.
• Process your Data in order to take steps at your request to attend to the workshops of the Exhibitors, in accordance with article 6, paragraph 1, point (b) of the GDPR.

6.7 Share your Data with the Exhibitors
Subject to having communicated to us your data for the purposes provided for in article 6.6, your data will be accessible to exhibitors who have obtained your permission to scan your badge using the Website.
The Exhibitors may scan your badge and obtain your Data for the duration of the Event.
For this purpose, and in accordance with article 6, paragraph 1, point (f) of the GDPR, TALENTSOFT has a legitimate interest in sharing your Data with the Exhibitors which will scan your badge.

6.8 Utilization of your Data by the Exhibitors
If you have consent to it when you registered to the Event, the Exhibitors which shall obtain your Data in the condition provided in articles 6.6 and 6.7 may use them in order to contact you for communication and marketing purposes.
For this purpose, we:
• communicate your Data to the Exhibitors for the duration of our contractual relations with them.
• Process your Data on the basis of your given consent in accordance with article 6, paragraph 1, point (a) of the GDPR. FOR THIS PURPOSE, YOU MAY WITHDRAW YOUR CONSENT AT ANY TIME, in that case the process shall end and your data shall be erased. Withdrawal of your consent does not compromise the lawfulness of the processing, based on consent, carried out prior to consent withdrawal.


Article 7 - User Rights:

It should be remembered that in the context of processing, and in accordance with the provisions of the Act and the GDPR, you have the following rights over your Data:
- Right to access (Article 15 of the GDPR);
- Right to rectification (Article 16 of the GDPR); - Right to erasure (Article 17 of the GDPR);
- Right to restriction of processing (Article 18 of the GDPR);
- Right to data portability (Article 20 of the GDPR);
- Right to object (Article 21 of the GDPR)
- Right to not be subject to decision solely based on automated processing, including profiling (Article 22 of the GDPR).
The rights listed above are personal and may only be exercised by people who have communicated their Data. To exercise these rights or for any other request involving them, you may contact TALENTSOFT through one of the means provided in Article 3 of this Privacy Policy.
When you contact TALENTSOFT directly, through whichever means, TALENTSOFT reserves the right to keep a record of this correspondence for a period necessary for processing the request, for a duration which shall not exceed two months.
You also have the right to lodge a complaint with the data protection authority. In France, the data supervisory authority is the “Commission Nationale de l’Informatique et des Libertés”, or CNIL (3 Place de Fontenoy, TSA 80715 – 75334 PARIS CEDEX 07).

TALENTSOFT’s full responsibility in the implementation of this Privacy Policy cannot exceed the limits provided in the General Conditions of Use.

TALENTSOFT reserves the right to amend or update its Privacy Policy at any time. As such, you are invited to consult this page regularly, since any browsing within the Website means you agree to the most recent version of the Privacy Policy.
A warning will be published and displayed on the Website when any significant amendment is made to this Privacy Policy.
This Privacy Policy is drawn up in French. Should there be any differences or contradictions with a version in a different language, the French version alone will be considered as authoritative and will apply.
